Terms of Service

These Terms of Service ("Terms") govern access to and use of Kirisan, including the marketing site at kirisan.com, the dashboard at dash.kirisan.com, the API at api.kirisan.com, and related documentation (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Kirisan is a messaging platform that lets you send, receive, and automate messages across supported channels — including WhatsApp (linked devices), WhatsApp Cloud API (WABA), Telegram, and email — from one dashboard. Features may include campaigns, scheduling, autoreply, contacts, webhooks, and a REST API. We may add, change, or remove features at any time.
2. Accounts
You sign in with Google. Kirisan does not offer a separate username or password. You are responsible for keeping your Google account secure and for all activity under your Kirisan workspace. You must provide accurate information and promptly update it if it changes.
One person or legal entity may not maintain more than one free-tier workspace for the same commercial purpose unless we approve it in writing. You may not share API tokens, device tokens, or session credentials with anyone who is not authorized to act on your behalf.
3. Acceptable use
You agree not to use the Service to:
- Send spam, unsolicited bulk messages, or messages without proper consent from recipients
- Harass, threaten, defraud, or impersonate others
- Distribute malware, phishing links, or illegal content
- Violate applicable law, including data-protection, telecom, and anti-spam regulations
- Violate the terms or policies of connected channels (Meta/WhatsApp, Telegram, email providers, and similar)
- Probe, scan, or attempt to breach our systems or other users' accounts
- Resell or sublicense the Service without our written permission
We may suspend or terminate access immediately if we reasonably believe you have violated these Terms or pose a risk to the Service, other users, or third-party providers.
4. Your content, contacts, and compliance
You retain ownership of content you submit — message text, templates, contact lists, files, and webhook payloads ("Your Content"). You grant us a limited license to host, process, transmit, and display Your Content solely to operate the Service.
You are solely responsible for obtaining any consent, opt-in, or legal basis required before messaging your contacts. You represent that your contact lists were collected lawfully and that recipients may receive messages from you through the channels you use.
5. Third-party channels and services
Kirisan connects to third-party networks and providers. Your use of those channels is also subject to their terms and policies, including:
- Google — for sign-in and, if you choose, Google Sheets integrations
- Meta / WhatsApp — for WABA and applicable WhatsApp policies
- Telegram — for bot messaging
- Email infrastructure — for outbound and inbound mail delivery
- WhatsApp linked-device providers — for device-linked WhatsApp sending
We do not control third-party networks. Outages, rate limits, account bans, template rejections, and conversation fees (including Meta charges on WABA) are outside our responsibility. WABA and some WhatsApp features may incur separate fees billed by Meta or other providers.
6. Plans, billing, and refunds
Paid plans, quotas, and add-ons are described on kirisan.com/pricing and in your dashboard. Prices are shown in Indonesian Rupiah unless stated otherwise. Free tiers may include usage limits, trial periods, or branding on outbound messages.
Unless required by applicable law or stated in a separate written agreement, fees are non-refundable once a billing period has started. Failed or reversed bank transfers may delay activation of paid features. We may change pricing with reasonable notice; continued use after a change constitutes acceptance of the new prices.
7. API, webhooks, and integrations
If you use the REST API or webhooks, you must keep credentials confidential, validate payloads on your servers, and use reasonable rate limits. You are responsible for endpoints you configure to receive webhooks. We may throttle or revoke API access to protect the Service.
8. Intellectual property
Kirisan, its branding, software, and documentation are owned by us or our licensors. These Terms do not grant you any right to our trademarks or to copy, modify, or reverse-engineer the Service except as allowed by law.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted delivery, error-free operation, or that messages will reach every recipient.
10. Limitation of liability
To the fullest extent permitted by law, Kirisan and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity. Our total liability for any claim arising from the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or IDR 1,000,000 if you have not paid fees, whichever is greater.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your account for breach of these Terms, non-payment, extended inactivity, or legal requirement. Upon termination, your right to use the Service ends. Sections that by nature should survive (including acceptable use, disclaimers, limitation of liability, and governing law) will survive termination.
12. Changes
We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be announced in the dashboard. Continued use after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction of the courts in Indonesia, unless mandatory consumer protection law in your country requires otherwise.
